Terms and conditions
These terms govern the use of SynerTrain. By creating an account you agree to be bound by them.
Purpose and acceptance
SynerTrain is a platform that lets personal trainers manage their clients, build training and nutrition plans, track their progress and communicate with them.
These terms form a contract between the owner of the platform and the person creating an account. By registering you declare that you have read and accept them, together with the privacy notice.
We may amend them to reflect legal or service changes. We will give you reasonable notice of any significant change, and if you do not accept it you may close your account.
Who may register
To create an account you must be of legal age and have capacity to enter into a contract. If you register as a trainer, you declare that you provide your services lawfully and that you hold any qualification or authorisation your activity may require.
You are responsible for the accuracy of the details you provide and for keeping them up to date, as well as for safeguarding your credentials. Tell us immediately if you suspect someone has accessed your account.
The trainer's account and their clients' accounts
The platform distinguishes two types of user. The trainer contracts the service, creates teams and invites their clients. The client accesses the space their trainer created for them and belongs to a single team.
The trainer decides which clients to add and what information to record about them. We do not intervene in that relationship: we do not supervise the plans, we do not validate their suitability, and we are not party to the service contract between a trainer and their client.
When a client stops working with their trainer, the trainer may remove them. Whether their data is kept or deleted at that point is the trainer's decision, on the terms of the following section.
Subscription, price, renewal and cancellation
A trainer's access to the platform requires a paid subscription, priced by the band that matches your number of active clients. The price and billing periods of each band are shown when you choose it.
Your first subscription starts with a free 30-day trial, for which we do not ask for payment details. If you want to carry on after it, you add a payment method from your account before it ends. If you have not added one by the time the trial ends, the subscription is cancelled automatically and you are not charged anything.
The subscription renews automatically at the end of each period unless you cancel beforehand. You can cancel at any time from your account; cancellation takes effect at the end of the period already paid for, during which you keep your access. What you have paid is not refunded, including the unused part of a yearly plan. When you move to a lower plan, the difference comes off your next invoices.
If a charge cannot be completed, we may suspend access after notifying you and allowing a reasonable period to put it right.
As this is a digital service performed immediately, if you are a consumer and ask for it to begin during the withdrawal period, you acknowledge that this period ends once the service has been fully performed, in accordance with consumer law.
Payments between a client and their trainer
The platform allows a client to pay their trainer for the services the trainer provides. That payment is processed through an external payment provider.
It matters that our role is clear: we only facilitate the payment. The service is provided by the trainer, who sets the price, issues the corresponding invoice and answers to their client for its performance. We are not party to that relationship and do not take part in any claims arising from it.
We never store card details: the payer enters them directly in the payment provider's environment.
The trainer's obligations regarding their clients' data
If you are a trainer, read this section carefully.
For your clients' data, you are the data controller and we act as processor on your behalf. That means, as a minimum, that it is for you to:
- Inform your clients what data you process, for what purpose and for how long.
- Obtain their explicit consent for health data (nutrition plans, measurements, progress photographs and review answers), which the law protects more strictly and for which performance of the contract is not a sufficient basis.
- Handle the requests for access, rectification, erasure, restriction, objection and portability that your clients address to you.
- Record only the data necessary for your service and keep it up to date.
Bear in mind that the private notes you write about a client, even though they cannot see them in the app, are that client's personal data and are covered by their right of access if they exercise it.
Use of the platform implies acceptance of the data processing agreement governing this relationship, which forms an integral part of these terms.
User-uploaded content and responsibility for it
The content you upload (plans, files, images, messages) remains yours. You grant us only the technical licence needed to host, process and display it to you within the service, with no other use.
You warrant that you hold the necessary rights over what you upload and that it infringes neither third-party rights nor applicable law. When you upload photographs of a person, you must have their consent.
We may remove manifestly unlawful content of which we have actual knowledge, or suspend the account responsible, without this giving rise to any right to compensation.
Service availability and limitation of liability
We work to keep the service continuously available, but we do not guarantee uninterrupted availability. There may be downtime for maintenance, updates or causes beyond our control, which we will try to announce in advance where foreseeable.
SynerTrain is a management tool, not a healthcare service. We do not provide medical, nutritional or sports advice, we neither create nor validate the plans, and we are not liable for the decisions a trainer takes about their clients or for their consequences.
The features that use artificial intelligence to read plans from PDF, Excel or Word files or from pasted text are a transcription aid: their output must be reviewed by the trainer before use, and we are not liable for interpretation errors that go uncorrected.
We are liable for damage we cause through wilful misconduct or gross negligence and for anything the law does not permit us to exclude. Beyond those cases, our liability is limited to the amount the user paid in the twelve months preceding the event giving rise to it. None of the above limits the rights consumer law grants to those who qualify as consumers.
Term, suspension and termination
The contract remains in force for as long as you keep your account. You may close it whenever you wish from your profile, in the app or in the web dashboard; the steps are on the account deletion page.
When you request deletion, the account is scheduled for deletion and your access is limited to your profile. The data is permanently purged after thirty days, a window intended to allow a deletion requested by mistake to be reversed. After that point recovery is no longer possible.
We may suspend or terminate an account that seriously breaches these terms, with prior notice unless the seriousness of the breach or the law requires immediate action.
If you are a trainer, you cannot close your account while you have active clients or a subscription that is still set to renew, free trial included. Before that, it is for you to inform your clients and decide what happens to their data, since you are the one accountable for it: deactivate them or transfer them to another trainer. Then cancel the subscription; you do not need to wait for the paid period to end. Bear in mind that the accounts of any clients you deactivate are deleted along with yours when the thirty-day period ends, together with their data; clients you transfer to another trainer keep theirs.
Governing law and jurisdiction
These terms are governed by Spanish law.
Any dispute shall be subject to the courts of the owner's domicile. If the user qualifies as a consumer, the jurisdiction assigned by consumer protection law prevails, which will be that of the consumer's own domicile.
